Haws ex rel. Haws v. Apfel, 61 F. Supp.2d 1266 (M.D. Fla. July 28, 1999)

This Social Security case was published following the Eleventh Circuit's holding in Falge v. Apfel, 150 F.3d 1320, 1322 (11th Cir. 1998). In Haws, the district court reviewed new evidence that was not seen by the administrative trial judge. The Court evaluated the new evidence because this matter involved a review of consideration given by the administration's Appeals Council. A district court will not defer to an agency's unreasonable interpretation of regulations that is manifestly contrary to the statutory standard.


The district court reversed the Commissioner's decision and awarded child SSI benefits to the plaintiff.

This case was remanded back to the Commissioner for consideration of the plaintiff's somatoform disorder and consideration of new evidence relative to the plaintiff's eye injury.


At the supplemental administrative hearing, the plaintiff's status of disability was recognized.
